FENCE RULES – SPARTANBURG (CITY), SOUTH CAROLINA

OVERVIEW

Residential fences are permitted on private property within the City of Spartanburg, South Carolina, subject to local regulations.

Fence installations are subject to mandatory permitting and specific standards for height, placement, and visibility. The City regulates fences to preserve neighborhood character, ensure traffic safety at intersections, and protect the local tree canopy. All fence installations require formal approval from the Planning Department to ensure compliance with the City’s Zoning Ordinance. Properties located within designated Historic Districts are subject to additional architectural review.

Compiled from the City of Spartanburg Zoning Ordinance (Section 403.2 and 501.8), the City Planning Department Fence Permit Application, and the City Land Development Regulations, as of February 2026.

GOVERNANCE

South Carolina does not publish a statewide residential fence code. For properties located within the Spartanburg city limits, fence standards are administered and enforced by the City of Spartanburg Planning Department.

The primary regulatory framework is established in Section IV (District Area and Dimensional Requirements) and Section V (General and Supplemental Regulations) of the City Zoning Ordinance. The Zoning Administrator is responsible for interpreting and enforcing these codes. While the City utilizes the International Residential Code (IRC) for structural safety, the local Zoning Ordinance provides the specific aesthetic and placement standards for residential fencing. City requirements do not override homeowners association (HOA) requirements or private covenants.

PERMIT AND APPROVAL REQUIREMENTS

The City of Spartanburg requires formal approval prior to the installation, repair, or replacement of any fence.

Fence Permit: A formal Fence Permit is REQUIRED for all installations within the city limits.
Application Process: To obtain a permit, property owners or contractors must submit a Fence Permit Application to the Planning Department.
Submittal Requirements: Applications must include a scale drawing or picture of the proposed fence showing its height and linear length, as well as a site plan or survey of the property showing the exact location of the fence relative to property lines and dimensions.
Historic Districts: If a property is located within a locally designated Historic District, the fence design may require a Certificate of Appropriateness (COA) from the Board of Architectural Design and Historic Review prior to permit issuance.
Tree Removal: The permit application requires homeowners to acknowledge and comply with the City’s tree removal requirements if any trees are to be affected by the fence installation.

FENCE PLACEMENT RULES

Fences must be located entirely on the owner’s private property and must not interfere with public infrastructure or traffic safety.

General Location: Fences and walls may be erected in any required yard or along the edge of any yard.
Encroachments: Fences are strictly prohibited from encroaching into public street rights-of-way or obstructing public sidewalks.
Utility Notification: South Carolina state law mandates that SC 811 be contacted at least three full business days prior to breaking ground on any fence project. The required waiting period excludes the day of the notice, weekends, and holidays, allowing utility operators time to verify and mark underground lines. Excavators must strictly adhere to the “tolerance zone” by utilizing only hand tools or soft digging methods within 24 inches of any utility indicators.
Easements: While fences may be placed along property edges, they should not be constructed within a utility easement in a manner that obstructs access for maintenance or repairs.

FENCE HEIGHT AND VISIBILITY RULES

Height limits and visibility standards apply to maintain neighborhood character and motorist safety.

Front Yard Height: In residentially zoned areas, a fence located in the front yard cannot exceed 4 feet in height.
Side and Rear Yard Height: Fences located in the side or rear yards cannot exceed 6 feet in height.
Visibility at Intersections (Sight Triangle): On corner lots, a strict Sight Triangle must be maintained for traffic safety.
• No fence, wall, or structure may be erected or maintained between the heights of 2.5 feet and 10 feet above the center line grades of the intersecting streets.
• This restriction applies within the triangular area formed by the street right-of-way lines for a distance of 25 feet from the intersection.
Structural Additions: Any fence or wall exceeding standard heights or requiring heavy masonry construction may trigger additional building permit requirements and structural review.

MATERIAL AND CONSTRUCTION LIMITS

The City requires fences to be constructed of standard residential materials and maintained in a safe condition.

Permitted Materials: Property owners must provide a description of proposed materials (e.g., wood, vinyl, ornamental metal) on the permit application for review.
Maintenance: All fences and structures must be maintained in a structurally sound condition and in good repair.
Safety Barriers: Fences serving as safety barriers for swimming pools must comply with specific structural and latching requirements defined in the adopted building codes.

PRIVATE RESTRICTIONS

Homeowners association (HOA) requirements and private covenants operate independently from the City of Spartanburg regulations. Private rules may impose fence height, material, or color requirements that are more restrictive than City standards (e.g., prohibiting chain link or requiring specific wood stains). The City does not monitor or enforce private easements, covenants, or deed restrictions. Property owners are responsible for ensuring their project meets both City ordinances and any applicable HOA rules.

REVIEW AND ENFORCEMENT CONTEXT

Fence issues are typically reviewed during permit or approval review when required, and through complaint-based code enforcement. Examples include:

• Installing a fence without a permit.
• Exceeding the 4-foot front yard or 6-foot side/rear yard height limits.
• Violating the 2.5-foot to 10-foot visibility restriction within the Sight Triangle on corner lots.
• Failure to adhere to Historic District guidelines when applicable.
• Failing to maintain a fence in a safe and upright condition.
