FENCE RULES – MAULDIN (CITY), SOUTH CAROLINA
OVERVIEW
Residential fences are permitted on private property within the corporate limits of Mauldin, South Carolina, subject to local regulations.
The City regulates fences to ensure they do not create traffic hazards at intersections or driveways and to maintain the aesthetic integrity of neighborhoods. While standard residential fences are exempt from a Zoning Permit based on the City’s definition of a “structure,” they remain subject to codified zoning standards for placement, opacity, and height. Properties located within specialized districts, such as the Urban Village District (UVD), are subject to specific architectural and material requirements.
Compiled from the City of Mauldin Zoning Ordinance and the City of Mauldin Code of Ordinances, as of February 2026.
GOVERNANCE
South Carolina does not publish a statewide residential fence code. For properties located within the Mauldin city limits, fence standards are administered by the Business and Development Services Department.
Primary governance is established through the City of Mauldin Zoning Ordinance, which regulates land use and structural placement. The Zoning Administrator is the authority responsible for the administration and enforcement of these regulations. Technical safety and structural standards are governed by the state-adopted International Residential Code (IRC). Municipal regulations function independently of private homeowners association (HOA) rules or covenants.
PERMIT AND APPROVAL REQUIREMENTS
Mauldin utilizes height thresholds and specific legal definitions to determine when a formal permit is necessary.
• Building Permit: In accordance with state-adopted technical codes, a building permit is generally required only for fences exceeding 7 feet in height or for masonry/concrete walls that require structural footings.
• Zoning Compliance: A building permit exemption is separate from zoning, setback, or plat requirements. Confirm any applicable zoning conditions, setbacks, and plat requirements with the City of Mauldin Building & Standards Department before construction.
• Administrative Compliance: Although a permit is not required for standard heights, property owners remain responsible for ensuring that fence placement, opacity, and height adhere to all codified zoning standards.
• Contractor Requirements: Every contractor or builder performing work in the city must remove all trash and debris incident to the construction at their own expense.
FENCE PLACEMENT RULES
Fences must be situated entirely on the owner’s private property and must not interfere with public infrastructure or utility access.
• Yard Encroachments: Fences and walls are permitted as allowable encroachments into required setbacks, provided they do not violate visibility standards.
• Rights-of-Way: No structure, including fencing, may project into a public street right-of-way or public alley.
• Easements: Fences should not be constructed in a manner that obstructs utility, drainage, or maintenance easements without specific authorization from the City or the easement holder.
• Utility Notification: South Carolina state law mandates that SC 811 be contacted at least three full business days prior to breaking ground on any fence project. The required waiting period excludes the day of the notice, weekends, and holidays, allowing utility operators time to verify and mark underground lines. Excavators must strictly adhere to the ‘tolerance zone’ by utilizing only hand tools or soft digging methods within 24 inches of any utility indicators.
FENCE HEIGHT AND VISIBILITY RULES
Height and visibility standards are applied to protect motorists and pedestrians and to maintain neighborhood character.
• Front Yard Standards: Fences and walls located in a front yard shall not be opaque (solid) above a height of 30 inches.
• Side and Rear Yard Standards: A fence or wall in a side yard or rear yard shall not be opaque above a height of 7 feet.
• Intersection Visibility (Sight Triangle): On corner lots, a strict Sight Triangle must be maintained. No fence or wall may be erected that creates a material impediment to visibility at the intersection of streets or driveways.
• Street Intersections: The sight triangle is measured from the curb or edge of pavement for a distance of 25 feet from the intersection of the street lines.
• Driveway Intersections: At the intersection of a driveway and a street, a visibility triangle of 10 feet must be maintained.
• Visibility Window: Within these triangles, obstructions are generally prohibited between the heights of 2.5 feet and 10 feet above the roadway grade.
MATERIAL AND CONSTRUCTION LIMITS
The City mandates the use of durable materials, with specific restrictions in place for designated redevelopment and village districts.
• General Residential: Mauldin City does not define permitted or prohibited fencing materials for standard residential use outside of specialized districts.
• Urban Village District (UVD) Standards: Within the UVD, only fences of an ornamental nature (such as wrought iron or picket fences) are permitted.
• UVD Prohibitions: The use of chain link fencing is strictly prohibited within the Urban Village District.
• Maintenance: All fences and walls must be maintained in a good state of repair. Fences that become dilapidated or pose a safety hazard may be declared a public nuisance.
PRIVATE RESTRICTIONS
Homeowners association (HOA) requirements and private covenants operate independently from the City of Mauldin regulations. Private rules often impose more restrictive standards, such as prohibiting specific materials, requiring specific wood stains, or limiting fence height to 4 feet in all yards. The City does not monitor or enforce private covenants; property owners are responsible for ensuring their project meets both City ordinances and any applicable HOA rules.
REVIEW AND ENFORCEMENT CONTEXT
Fence issues are typically reviewed during permit or approval review when required, and through complaint-based code enforcement. Examples include:
• Constructing a fence that obstructs the sight triangle at a corner lot or driveway.
• Installing a fence that exceeds 7 feet in height or opacity limits without a permit.
• Placement of a fence within a public right-of-way or over a utility easement.
• Using prohibited chain link or non-ornamental materials in the Urban Village District.
• Failure to remove construction debris following the completion of a project.
