FENCE RULES – IRMO (TOWN), SOUTH CAROLINA
OVERVIEW
Residential fences are permitted on private property within the corporate limits of the Town of Irmo, South Carolina, subject to local regulations.
Fence and wall standards address height, placement, and intersection visibility. The Town applies a reduced height limit for fences located within the required front yard setback while allowing higher fence heights in side and rear yards. Properties located within city limits (such as Columbia or Lexington) follow their respective municipal rules.

GOVERNANCE
South Carolina does not publish a statewide residential fence code. For properties located within the Town of Irmo, fence standards are administered and enforced by the Planning and Zoning Department.
Primary regulatory authority is established in Appendix A (Zoning) of the Town Code, specifically Section 3-1, Section 3-4, and Section 3-10. The Planning Official is the authority responsible for the administration of these regulations. Technical structural safety follows the town-adopted International Building and Residential Codes. Town requirements do not override homeowners association (HOA) requirements or private covenants.
PERMIT AND APPROVAL REQUIREMENTS
The Town of Irmo utilizes height-based structural thresholds to determine when a fence project requires formal city oversight.
• Building Permit Exemption: In accordance with the state-adopted International Residential Code (IRC), standard residential fences that do not exceed 7 feet in height are exempt from structural building permit requirements.
• Building Permit Requirement: Any fence or wall structure reaching or exceeding 7 feet in height requires a formal building permit from the Town to verify structural integrity and wind-load compliance.
• Zoning Compliance: Building permit requirements are separate from zoning, setback, or plat requirements. Confirm any applicable zoning conditions, setbacks, and plat requirements with the Planning and Zoning Department before construction.
• Swimming Pool Barriers: Fences serving as safety enclosures for swimming pools must comply with specific barrier requirements, which include a minimum height of 48 inches and the use of self-closing, self-latching gates.
FENCE PLACEMENT RULES
Fences must be situated entirely on the owner’s private property and must not interfere with public infrastructure or roadway safety.
• Property Lines: The ordinance does not state a setback requirement for standard residential fences from property lines; however, fences must be located entirely on the owner’s property and must not encroach into rights-of-way or easements. Owners are responsible for ensuring no portion of the structure encroaches onto public rights-of-way or adjacent parcels.
• Setback Encroachments: Fences, walls, and hedges are permitted to project into required yard setbacks provided they adhere to the Town’s height and visibility limits.
• Fire Safety: No person shall place or keep any fence or material near a fire hydrant in a manner that prevents the hydrant from being immediately discernible or hinders access.
• Drainage: Fences must not be installed in a manner that blocks or diverts natural drainage flow or interferes with town-maintained utility or maintenance easements.
• Utility Notification: South Carolina state law mandates that SC 811 be contacted at least three full business days prior to breaking ground on any fence project. The required waiting period excludes the day of the notice, weekends, and holidays, allowing utility operators time to verify and mark underground lines. Excavators must strictly adhere to the ‘tolerance zone’ by utilizing only hand tools or soft digging methods within 24 inches of any utility indicators.
FENCE HEIGHT AND VISIBILITY RULES
Height limits in Irmo are strictly determined by the fence’s location on the lot and its proximity to street intersections.
• Front Yard Setback: Fences located within the required front yard setback area are limited to a maximum height of 4 feet. On residential lots, the yard in front of the front door is considered the primary front yard.
• Side and Rear Yard Height: Residential fences and walls in side and rear yards are permitted up to a maximum height of 8 feet.
• Intersection Visibility (Sight Triangle): On any corner lot, a triangular “visual clearance area” must be maintained at the intersection of two streets.
• Visibility Threshold: Within this sight triangle, no fence, wall, sign, or planting may be located that obstructs the vision of motorists.
• Diameter Exception: Support structures and poles less than 12 inches in diameter may be permitted within the visual clearance area.
MATERIAL AND CONSTRUCTION LIMITS
Fences must be constructed of durable materials and maintained in a safe, upright condition.
• Maintenance: Property owners are legally required to maintain all fences and walls to builder standards. Fences must not lean, have missing parts, or have loose components.
• Litter Prevention: Property owners must ensure that no loose or trapped litter accumulates at the base of fences.
• Signage Prohibition: It is prohibited to tack, nail, or otherwise attach advertising or informational materials to residential fences.
• Buffer Screens: When a fence is used as part of a required buffer screen between land uses, it must be constructed of wood or masonry (block, brick, or stucco).
PRIVATE RESTRICTIONS
Homeowners association (HOA) requirements and private covenants operate independently from Town of Irmo regulations. Because the Town’s regulatory footprint is focused on safety, private subdivisions often utilize recorded covenants to impose more restrictive standards, such as prohibiting specific materials (e.g., chain link), requiring specific wood stains, or limiting all fences to 6 feet in height. The Town does not monitor or enforce private covenants; property owners are responsible for ensuring their project meets both Town ordinances and any applicable neighborhood-specific restrictions.

Fence issues are typically reviewed during permit or approval review when required, and through complaint-based code enforcement. Examples include:
• Installing a fence 7 feet or taller without a required building permit.
