FENCE RULES – FOREST ACRES (CITY), SOUTH CAROLINA

OVERVIEW

Residential fences are permitted on private property within the City of Forest Acres, South Carolina, subject to local regulations.

These standards address residential fences and walls, including requirements for height, materials, and placement. The City transitioned to a Unified Development Ordinance (UDO) in December 2025, which serves as the primary authority for site and development standards intended to maintain the community’s “forested” character and to address public safety and intersection visibility. GOVERNANCE

South Carolina does not publish a statewide residential fence code. For properties located within the City of Forest Acres, fence standards are established by the Unified Development Ordinance (UDO), which superseded all prior independent Zoning and Land Development ordinances on December 9, 2025. This Ordinance is adopted under the authority conferred by the South Carolina Local Government Comprehensive Planning Enabling Act of 1994.

Administration and enforcement are conducted by the Zoning Administrator and the Building Official. The Land Development Administrator conducts UDO compliance reviews to evaluate proposed structures against the City’s minimum site and development standards. These municipal regulations function independently of private homeowners association rules.

PERMIT AND APPROVAL REQUIREMENTS

A Building Permit is required for the construction or installation of a fence in Forest Acres. The City classifies a fence as a “structure,” and under the UDO, no structure may be erected or structurally altered unless it conforms to the regulations of the applicable zoning district. This requirement provides for a UDO Compliance Review to verify height, material, and visibility requirements prior to work beginning.

Tree Protection: All permit applications for fence projects involving ground disturbance must include a review of “significant trees”. A tree survey is required to identify protected species within 10 feet of the proposed work area.
Zoning Conformity: A permit is issued only if the project conforms to the regulations of the applicable zoning district, including specific transparency rules for front yards.
Final Inspection: Upon completion of the project, the installation may be inspected to verify that the structure matches the approved permit and site plan.

FENCE PLACEMENT RULES

Fence placement in Forest Acres is governed by property boundaries, easements, rights-of-way, and sightline protection.

Required Yards: Fences and walls are permitted within the required yards of all zoning districts.
Property Lines: The ordinance does not state a setback requirement for standard residential fences from property lines; however, fences must be located entirely on the owner’s property and must not encroach into rights-of-way or easements.
Easement Restrictions: The installation of fences is strictly prohibited within drainage easements containing swales. Fences may not be placed in any utility or drainage easement in a manner that obstructs necessary maintenance or the flow of water.
Rights-of-Way: It is unlawful to place a fence or any other obstruction within a public street, highway, or sidewalk right-of-way.
Utility Notification: South Carolina state law mandates that SC 811 be contacted at least three full business days prior to breaking ground on any fence project. The required waiting period excludes the day of the notice, weekends, and holidays, allowing utility operators time to verify and mark underground lines. Excavators must strictly adhere to the “tolerance zone” by utilizing only hand tools or soft digging methods within 24 inches of any utility indicators.

FENCE HEIGHT AND VISIBILITY RULES

The City regulates fence height based on yard location and material opacity to address neighborhood aesthetics and visibility.

Maximum Height: Fences and walls in all residential zoning districts are limited to a maximum height of 7 feet.
Front Setback Limits: Fences located within the front setback area of a residential lot are subject to a height cap of 4 feet if they are 100% opaque (solid).
Transparency Requirement: Any fence structure in a residential front setback that exceeds 4 feet in height (up to the 7-foot limit) must be transparent to allow visibility through the material.
Sight Triangles: Fences must comply with “Visibility at Intersections and Access Points” standards. No fence may be placed where it would obstruct the vision of vehicular traffic at a street corner or driveway entrance.

MATERIAL AND CONSTRUCTION LIMITS

Buffering Standards: Where a fence is used as a transition buffer between commercial and residential uses, it must be constructed of an opaque material such as masonry or rot-resistant wood.

PRIVATE RESTRICTIONS

Homeowners association (HOA) requirements and private covenants operate independently from the City of Forest Acres regulations. Private rules may impose more restrictive standards regarding fence height, material, style, or color (e.g., prohibiting wood fences or requiring specific ornamental designs). The City does not monitor or enforce private easements, covenants, or deed restrictions. City approval or the issuance of a building permit does not override private restrictions or the need for HOA approval.

• A fence is placed in a manner that obstructs the sight visibility triangle at an intersection.
• A structural addition to a nonconforming fence further increases its nonconformity.
