Residential fences are permitted on private property within the Town of James Island, South Carolina, subject to local regulations.
Residential fences and walls are subject to standards for height, placement, and public safety. The Town regulates fencing to address visual barriers for motorists, stormwater drainage impacts, and encroachment into public rights-of-way. GOVERNANCE
South Carolina does not publish a statewide residential fence code. For properties located within the Town of James Island, fence standards are administered by the Building Services Department and the Zoning and Livability Department.
Governance is established through Chapter 153 (Zoning) of the Town of James Island Code of Ordinances. The Zoning Administrator is the authority responsible for the interpretation and enforcement of land use regulations, while the Building Official oversees structural safety and compliance with adopted technical codes. Town requirements do not override homeowners association (HOA) requirements or private covenants.
PERMIT AND APPROVAL REQUIREMENTS
The Town of James Island utilizes height-based structural thresholds to determine when a fence project requires formal city oversight.
• Building Permit Exemption: In accordance with the state-adopted International Residential Code (IRC), standard residential fences that do not exceed 7 feet in height are exempt from structural building permit requirements.

• Swimming Pool Barriers: Fences serving as safety enclosures for swimming pools must comply with specific barrier requirements (minimum 48 inches) defined in the adopted safety codes, regardless of the 7-foot permit threshold.
• Accessory Structures: Masonry or stone walls may require a structural permit if they utilize a footer or exceed a specific weight and height threshold as determined by the Building Official.
FENCE PLACEMENT RULES
Fences must be situated entirely on the owner’s private property and must not interfere with public infrastructure or utility maintenance.
• Property Lines: The ordinance does not state a setback requirement for standard residential fences from property lines; however, fences must be located entirely on the owner’s property and must not encroach into rights-of-way or easements.
• Public Rights-of-Way: Fences are prohibited from being placed within a public right-of-way, including area used for public sidewalks, drainage ditches, or road shoulders.
• Drainage and Easements: Fences must not be installed in a manner that blocks or diverts the natural flow of stormwater or interferes with town-maintained drainage easements.
• Utility Notification: South Carolina state law mandates that SC 811 be contacted at least three full business days prior to breaking ground on any fence project. The required waiting period excludes the day of the notice, weekends, and holidays, allowing utility operators time to verify and mark underground lines. Excavators must strictly adhere to the ‘tolerance zone’ by utilizing only hand tools or soft digging methods within 24 inches of any utility indicators.
FENCE HEIGHT AND VISIBILITY RULES
The Town prioritizes safety envelopes and visibility at intersections to ensure the safety of pedestrians and motorists.
• Standard Rear and Side Yard Height: Residential fences in side and rear yards are described as permitted up to a maximum height of 6 feet (or 8 feet depending on the specific zoning district setback).
• Front Yard Height: Fences located within the required front yard setback are described as subject to a lower height (often 4 feet) and may be required to be of an “open” style (such as picket or split-rail).
• Vision Clearance Triangle: On corner lots, a triangular “safety zone” must be maintained where two streets intersect.
• Visibility Threshold: Within this 25-foot vision clearance triangle, no fence, wall, or structure may be maintained at a height between 2.5 feet and 10 feet above the curb level.

PRIVATE RESTRICTIONS
Homeowners association (HOA) requirements and private covenants operate independently from Town of James Island regulations. Because many developments on James Island were established with specific architectural standards, private rules often impose more restrictive standards than the Town, such as prohibiting specific wood stains, requiring black aluminum instead of wood, or prohibiting solid “privacy” fences in front of the building line. The Town does not monitor or enforce private covenants; property owners are responsible for ensuring their project meets both Town ordinances and any applicable neighborhood-specific restrictions.
