FENCE RULES – BEAUFORT (CITY), SOUTH CAROLINA
OVERVIEW
Residential fences are permitted on private property within the corporate limits of the City of Beaufort, South Carolina, subject to local regulations.
The City enforces a “Good Neighbor” policy requiring support structures to be positioned on the interior of the lot and restricts fence heights in front and street-side setbacks to preserve the visual continuity of the streetscape. Properties located within the Beaufort Historic District are subject to additional design guidelines and material prohibitions.

GOVERNANCE
South Carolina does not publish a statewide residential fence code. For properties located within the City of Beaufort, fence standards are administered by the Department of Planning and Development Services and the Building Codes Office.
Primary regulatory authority is established through the Beaufort Development Code, specifically Section 2.5.6 (Encroachments) and Section 5.8 (Fencing). Structural safety is governed by the city-adopted International Residential Code (IRC) and the International Building Code (IBC). City requirements do not override homeowners association (HOA) requirements or private covenants.
PERMIT AND APPROVAL REQUIREMENTS
The City of Beaufort requires administrative review for fence projects to ensure compliance with the city’s form-based zoning and historic preservation standards.
• Zoning Permit: A Zoning Permit is REQUIRED for the installation of any residential fence or wall to verify that height and placement adhere to the applicable Transect or Conventional district standards.
• Building Permit: A structural building permit is required for fences exceeding 7 feet in height or for masonry/stone walls that require structural footings.
• Historic District Review: Any fence proposed within the Beaufort Historic District requires a Certificate of Appropriateness (COA) from the Historic District Review Board (HRB) or staff prior to installation.
• Exemptions: Retaining walls on single-family residential property located outside the Historic District that are not over 4 feet in height (measured from the bottom of the footing) are exempt from building permits, provided they do not support a surcharge.
FENCE PLACEMENT RULES
Fences must be situated entirely on the owner’s private property and must not interfere with public infrastructure or utility maintenance.
• Good Neighbor Rule: The structural support members (posts and rails) of all fences must be located on the inside of the fence, facing the owner’s property, so that the finished side faces the street or neighbor.
• Setback Encroachments: Fences and garden walls are permitted to encroach into required front, side, and rear yard setbacks provided they meet height limitations.
• Public Rights-of-Way: Fences are strictly prohibited from being located within or overhanging a public right-of-way, including sidewalks.
• Utility Notification: South Carolina state law mandates that SC 811 be contacted at least three full business days prior to breaking ground on any fence project. The required waiting period excludes the day of the notice, weekends, and holidays, allowing utility operators time to verify and mark underground lines. Excavators must strictly adhere to the “tolerance zone” by utilizing only hand tools or soft digging methods within 24 inches of any utility indicators.
• Drainage: Fences must be installed in a manner that does not obstruct the natural flow of stormwater or interfere with the City’s stormwater system.
FENCE HEIGHT AND VISIBILITY RULES
Height limits in Beaufort are determined by yard location and whether the property is in a Transect-Based or Conventional zoning district.
• Front or Street Side Setback: Maximum height is 4 feet.
• Ribaut Road Exception: On T3 lots fronting Ribaut Road, fences may reach 7 feet in height, provided the fence is set back from the property line an additional 1 foot for every 1 foot of height above 4 feet.
• Interior Side or Rear (Transect Districts): Maximum height is 6 feet.
• Interior Side or Rear (Conventional Districts): Maximum height is 8 feet.
• Intersection Visibility: Plants, fences, and walls must be maintained in a manner that does not obstruct sight distances at roadway and driveway intersections.
• Visibility Window: Within designated sight triangles, no obstruction is permitted that interferes with the driver’s line of sight, typically between 2.5 feet and 10 feet in elevation.
MATERIAL AND CONSTRUCTION LIMITS
The City mandates specific material standards to ensure fences are compatible with the community’s coastal and historic character.
• Chain Link Restrictions: Chain link fencing is PROHIBITED in the Beaufort Historic District. Outside the Historic District, chain link may not extend past the front of any primary structure and is not permitted along any street right-of-way.
• Electric Fencing: Electric fences are PROHIBITED from encroaching into any front or street side setbacks.
• Prohibited Materials: Barbed wire, razor wire, and similar hazardous materials are prohibited in residential districts.
• Maintenance: All fences and walls must be maintained in a healthy and orderly appearance, kept vertical, and remain free from rot, rust, or dilapidated sections.
• Signage: It is prohibited to attach or paint signs, flags, or banners onto fence posts.
PRIVATE RESTRICTIONS
Homeowners association (HOA) requirements and private covenants operate independently from City of Beaufort regulations. Private rules may impose more restrictive standards, such as prohibiting specific materials (e.g., vinyl), requiring specific paint colors, or limiting all fences to 4 feet in height. The City does not enforce private covenants; however, per state law, the City cannot issue a permit for an activity that is expressly prohibited by recorded covenants. Property owners are responsible for ensuring their project meets both City ordinances and any applicable neighborhood-specific restrictions.

Fence issues are typically reviewed during permit or approval review when required, and through complaint-based code enforcement. Examples include:
• Installing a fence in the Historic District without an approved COA.
• Constructing a fence with the unfinished side facing the street or neighbor.

• Placement of chain link fencing along a public right-of-way.
• Failure to maintain a fence, resulting in an unstable or dilapidated structure.
