FENCE RULES – NORTH AUGUSTA (CITY), SOUTH CAROLINA

OVERVIEW

Residential fences are permitted on private property within North Augusta, South Carolina, subject to local regulations.

Fence standards address height, placement, and architectural orientation. The City regulates fences to preserve neighborhood character and support traffic safety through “Good Neighbor” design requirements and intersection visibility mandates. PERMIT AND APPROVAL REQUIREMENTS

North Augusta uses defined criteria to determine when a building permit or engineering design is required for a project.

Fence Permit Exemption: Standard building permits are NOT REQUIRED for the installation of residential fences that meet City height and placement standards.
Wall Permit Requirement: Any wall structure over 4 feet in height requires a building permit and professional engineer design.
Encroachment Approval: Fences or walls proposed for placement within a public right-of-way or easement are prohibited without specific administrative authorization.
Zoning Compliance: Building permit requirements are separate from zoning, setback, or plat requirements. Confirm any applicable zoning conditions, setbacks, and plat requirements with the Department of Planning & Development before construction.

FENCE PLACEMENT RULES

Fences must be situated entirely on the owner’s private property and are restricted from obstructing public infrastructure.

Property Lines: The ordinance does not state a setback requirement for standard residential fences from property lines; however, fences must be located entirely on the owner’s property and must not encroach into rights-of-way or easements.
Setback Encroachment: Fences are generally allowed to project into required yards and setbacks.
Public Rights-of-Way: No fence or wall may be placed within a public right-of-way or obstruct public sidewalks.
Intersection Sight Triangle: Fences must not extend into the “sight triangle” at a street intersection.
Utility Notification: South Carolina state law mandates that SC 811 be contacted at least three full business days prior to breaking ground on any fence project. The required waiting period excludes the day of the notice, weekends, and holidays, allowing utility operators time to verify and mark underground lines. Excavators must strictly adhere to the “tolerance zone” by utilizing only hand tools or soft digging methods within 24 inches of any utility indicators.
Easements: Fences should not be constructed in a manner that obstructs access to recorded utility or drainage easements.

FENCE HEIGHT AND VISIBILITY RULES

Height limits are defined based on the location of the fence on the residential lot to maintain aesthetics and motorist safety.

Front Yard Setback: Fences located within the required front yard setback may not exceed 4 feet in height.
Side and Rear Yards: Fences located in any yard other than the front yard setback are limited to a maximum height of 7 feet.
Exceeding Standard Heights: Fences and walls not located in a required setback may be constructed to the height of the principal structure at the eaves, subject to architectural approval by the Director.
Intersection Visibility (Sight Triangle): On corner lots, no fence, wall, or obstruction is permitted within the 25-foot sight triangle formed by the intersection of right-of-way lines.
Visibility Window: Within this triangle, no obstruction is allowed between the heights of 2.5 feet and 7 feet above the roadway grade.

MATERIAL AND CONSTRUCTION LIMITS

The City specifies materials and orientation to support compatibility with neighborhood architectural vernacular.

Finished Side Out: The finished side of a fence must face outward toward the public right-of-way or adjacent property.
Permitted Materials: Residential fences must be constructed of wood, brick, stone/synthetic stone, wrought iron, or block/stucco (if matching the principal structure).
Chain Link Restrictions: Black vinyl-clad chain link is permitted. Standard non-clad chain link is permitted on individual residential lots; in common areas, it is addressed as restricted.
Barbed Wire Prohibition: It is unlawful to erect or maintain a barbed wire fence along and within 20 feet of any street or public sidewalk.
Gate Clearance: No gate or door attached to a fence may open into or upon any public street, sidewalk, or public square.

PRIVATE RESTRICTIONS

Homeowners association (HOA) requirements and private covenants operate independently from City of North Augusta regulations. Private rules often impose more restrictive standards, such as capping heights at 4 feet in all yards, prohibiting certain materials (like chain link), or requiring specific colors. The City does not monitor or enforce private covenants; property owners are responsible for ensuring their project meets both City ordinances and any applicable neighborhood-specific restrictions.
