FENCE RULES – SUMMERVILLE (TOWN), SOUTH CAROLINA

OVERVIEW

Residential fences are permitted on private property within the Town of Summerville, South Carolina, subject to local regulations.

PERMIT AND APPROVAL REQUIREMENTS

Utility Notification: South Carolina state law mandates that SC 811 be contacted at least three full business days prior to breaking ground on any fence project. The required waiting period excludes the day of the notice, weekends, and holidays, allowing utility operators time to verify and mark underground lines. Excavators must strictly adhere to the ‘tolerance zone’ by utilizing only hand tools or soft digging methods within 24 inches of any utility indicators.

FENCE HEIGHT AND VISIBILITY RULES

Summerville restricts fence height based on the location of the fence relative to the primary structure.

Front Yards: Fences located between the front building line and the street may not exceed 4 feet in height.
Side and Rear Yards: Fences located behind the front building line may not exceed 6 feet in height.
Vision Clearance (Sight Triangle): To ensure traffic safety, a Sight Triangle must be maintained at all intersections and driveway connections.
• No fence, wall, or hedge may exceed 3 feet in height within the 25-foot sight triangle at street intersections.
• Fences near driveways must not obstruct the view of pedestrians or passing vehicles.

MATERIAL AND CONSTRUCTION LIMITS

Permitted Materials: Acceptable materials include wood (naturally decay-resistant or pressure-treated), ornamental iron or aluminum, brick, stone, and high-quality vinyl.
Prohibited Materials:
Chain Link: Prohibited in front yards of residential properties.
Barbed/Razor Wire: Strictly prohibited in all residential districts.
Salvaged Materials: Fences may not be constructed of scrap metal, plywood, or other non-traditional fencing materials.
Maintenance: Property owners are required to maintain fences in a good state of repair. Fences that are leaning, have missing boards, or show significant rot are considered violations of the Town’s property maintenance standards.

PRIVATE RESTRICTIONS

HOA requirements and private covenants operate independently from the Town of Summerville’s regulations. Compliance with Town ordinances does not exempt a homeowner from their civil obligation to follow neighborhood-specific covenants.
